These Terms and Conditions govern your use of online shop www.espaciadores.eu . We reserve the right to change the Terms and Conditions at any time and it is your responsibility to check regularly before ordering. This does not affect your statutory rights.

CONTRACTUAL PARTNER

These Terms and Conditions govern all sales terms of any product ordered by you on webshop, owned by Gijura MB.

By using our webshop, you accept these Terms and Conditions in full. If you disagree with these Terms and Conditions or any part of these Terms and Conditions, you should not use this webshop.

In these Terms and Conditions, when we refer to we, us or our, webshop, we mean Gijura MB. Where we refer to you, your or the customer, we mean you, the person using the Services.

CONTRACT CONCLUSION

An order can be placed at webshop as follows:

           or by mail to the address listed below

In any case, an order is only possible if the customer has identified himself prior by his e-mail address or some other form of personal information.

In order to place an order, you should be at least 18 years old.

If you are a minor, ask your parents or legal representatives to place the order in your name. You can request information about products at any age. In any case, it is advisable to have your parents or legal representatives before navigating and/or registering on our webshop or mobile applications so that they can explain any questions that arise.

By placing an order, the customer places a binding offer to conclude a sales contract.

Webshop will then send you a confirmation of receipt of the order via e-mail. This e-mail only serves as non-binding information to the customer. A contract between e-Shop and the customer only comes into existence, when:

           Gijura MB sends an order confirmation per e-mail to the customer;

           Gijura MB ships the ordered items to the customer;

           Gijura MB asks the customer for payment after he/she placed his/her order.

In case there is any problem with the delivery of your order, we will contact you as soon as possible to inform you about the situation and suggest alternative products that you may wish to purchase. Or offer the refund of the amount paid when placing the order.

The products availability on our webshop may constantly change and reflects the situation in real time. By adding an item to the shopping basket, it does not guarantee that it will be reserved for you, as other customers may have already purchased it. Only when the payment process has been completed, the product is effectively reserved for the customer.

Gijura MB will make every effort to provide you with the products listed in your order confirmation. However, there may be times when it is impossible for us to supply such products because, for example, a stock issue. In these cases we will contact you to inform you and suggest alternative products that you may wish to purchase.

RIGHT OF WITHDRAWAL

Consumers have a statutory right of withdrawal as follows, whereby a consumer is any natural person who concludes a legal transaction for purposes which can predominantly be attributed neither to his commercial nor his self-employed professional activity.

You may cancel the order at any time and at no additional cost, provided that it has not been invoiced and sent through the shipping company. If the parcel has left our warehouse, you may reject it when being delivered by the shipping company.

You have the right to revoke this contract within fourteen days without giving reasons.

The revocation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took or has taken possession of the last goods.

To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by means of a clear declaration (e.g. a letter send by e-mail). You can use the attached sample revocation form, which is not mandatory.

LISTING OF PRODUCTS

The items available are described and presented with as much precision as possible. You must read the description of each product in order to know the specific details and properties. The choice and purchase of a product is the sole responsibility of the customer. However, should an error or omission occur within the information, webshop cannot be held responsible. All customers are invited to inform webshop of any error that can be found in a product description.

PRODUCT PRICES AND SHIPPING COSTS

All prices are clearly shown on our websites. Prices can be changed frequently. The valid prices for each order are based on the moment the order has been placed. Price is shown per 1pc, accessories included as per photo.

Prices are shown as follow:
- For orders being shipped to countries within the European Union, VAT determined by law is already included in the product price you see on our webshop. So VAT and any sales taxes are already included and you will only be charged the product price and the shipping fees.

Our shipping fees are calculated by weight and volume, so by adding any item to the basket, the respective shipping fees are shown and the delivery option can be selected, once all items have been added to the basket.

PAYMENT

Our main payment methods are PayPal, Credit/Debit card, bank transfer. Please keep in mind that offered payment methods may vary by the country of destination. Once all items have been added to the basket and you already selected the courier, all available payment methods for your destination country will be shown.

For online payments made by credit card, the "Secure Socket Layer" (SSL) security system is used, which allows encrypting your banking information when on the network.

Please note: PayPal refunds made more than 60 days after the original payment are considered new payments and regular PayPal fees for receiving money will incur. Gijura MB will refund the value of the product returned; the total amount of money received will reflect the refund less any PayPal fees.

You have the right to receive the paper invoice free of charge, although if you do not state otherwise in your order, we will understand that you expressly consent to receive it electronically (by e-mail). This consent may be revoked by you at any time, by contacting our Service team, through the contact section.

DELIVERY

Webshop will inform the customer of the transfer, via email, when order is shipped. In exceptions (especially if the products are out of stock or if bulk goods are being ordered) there can be a difference of up to 15 business days between receipt of payment and delivery.

To ensure the safe delivery of your parcel, the courier company needs a signature to confirm successful delivery. If there is nobody to receive the parcel, the driver will attempt a new delivery, deposit your parcel at a neighbor or take your parcel to be securely held at the local Post Office or Depot.

In case your parcel could not be delivered due to any reason, such as incorrect address, wrong delivery details, refuse of the parcel, etc., it will normally be returned directly to us. Please keep in mind we can only refund your paid product price, once the parcel has arrived back at our warehouse and any item could be verified.

You will receive the refund of the paid product price by the same payment method you used when placing the order. Any paid shipping fees cannot be refunded.

SHIPPING CLAIMS MANAGEMENT

Claims for packages marked "delivered" must be filed after 3 days and before 15 days from the date the package was marked “delivered.”

Claims for packages presumed to be lost (where the status is not “delivered”) must be filed after 3 days and within 15 days from the last tracking update.

If the products selected by the customer are not available at the time the order is placed, webshop will inform the customer upon receipt of the order. If there is a possible delivery delay of more than two weeks, the customer will be informed about the delay and has the right to cancel his order.

RETURNING INFORMATION

You can return any item within 14 days, as long as the item/s is/are in perfect conditions (unused, with labels, in original packaging)

If you revoke this Agreement, we shall reimbourse you immediately and no later than fourteen days from the date on which we receive notice of your revocation of this Agreement for all payments we have received from you, excluding delivery charges. For this refund we will use the same means of payment that you used for the original transaction. We may refuse to refund until we have received the goods back or until you have provided evidence that you have returned the goods, whichever is earlier.

You should return the goods to us immediately and in any case within fourteen days of the day on which you notify us of the withdrawal of this contract at the latest. This period shall be deemed to have been met if you dispatch the goods before expiry of the period of fourteen days.

Cost of returning the goods will be at your expense. You shall only be liable for any loss in value of the goods if such loss in value is due to handling of the goods which is not necessary for testing their condition, properties and functionality.

DEFECT WARRANTY, GUARANTEE

Gijura MB is liable for defects in accordance with the respective legally applicable regulations. Legal warranty term is according to EU directive is 24 months for consumers, starting with the delivery date, if it is not indicated otherwise. Our company warranty term is 12 months.

If a fabrication defect is recognized by the manufacturer, all the generated shipment costs, both for the return shipment as for the shipment of the replaced or repaired item, are at our expense. We reserve the right to refuse the exchange of an item in case the returned item doesn´t arrive in the conditions indicated in our returns policy. So once we receive any answer regarding your case, we will be able to act immediately as indicated by the brand. You will be informed directly by us if the guarantee has been accepted and if so, if the manufacturer will repair or replace the item.

LIABILITY

Gijura MB is liable in accordance with the legal requirements if it violates key contractual obligations. Unless Gijura MB acts grossly negligent or intentionally causes damages, liability is limited to typically occurring foreseeable damages. Key contractual obligations are obligations which determine the typical purpose of the contract, and whose completion only enables the proper execution of the contract and the contractual partner can rely on them being adhered to on a regular basis.

Gijura MB is only liable for any other violations of obligations if the damage was caused intentionally or due to gross negligence by a legal representative or auxiliary person.

Unless something different is stated above, claims for damages against Gijura MB resulting from violations of obligations are excluded.

Gijura MB is not responsible for any consequences that may result from improper use of the products sold in its online shop.

INTELLECTUAL PROPERTY AND COPYRIGHT

All content of the online shop ( texts, descriptions, own brands, images) is property of Gijura MB. The third-party trademarks are property of their owners. Any partial and total reproduction of the content by any processes and by any medium are subjected to prior and express authorization to Gijura MB or any right holders.

Gijura MB is not responsible for the misuse of our websites contents, the responsibility is exclusively for the user who accesses them or uses them.

Gijura MB declines all responsibility of any disputes arising from the exchange of information between users through our websites. The responsibility of publishing data and information through their websites is in any case for those who published them.

AMENDMENT TO THE TERMS

We reserve the right to amend these Terms and Conditions at any time. All amendments to these Terms and Conditions will be posted online. However, continued use of the site will be deemed to constitute acceptance of the new Terms and Conditions.

APPLICABLE LAW

These Terms and Conditions and your use of the websites shall be governed by and construed in accordance with Lithuanian law. You submit to the exclusive jurisdiction of the Lithuanian courts to settle any dispute which may arise under these Terms and Conditions.
